1. General information
Welcome to SafeBoat. These Terms of Service (“Terms”) govern your access to and use of the SafeBoat mobile application (“App”) and the SafeBoat website (“Website”), together the “Services”. By downloading, installing or using the App, or by using the Website, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. About SafeBoat
SafeBoat helps boat owners, captains and crew keep their boat and themselves safer: an anchor alarm, marine weather, the I’m OK check-in timer, an AI route planner, trip recording, BoatGPT (answers about boats and their manuals), pairing between phones, offline maps and shared anchorage notes. SafeBoat is a supportive and informational tool. It does not replace proper navigation, seamanship or safety practices, official charts, or the manufacturer’s manuals and service.
At present SafeBoat is operated by an independent developer and is provided free of charge. Future updates may bring company ownership or paid services, at which time these Terms may be updated.
3. Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use the Services. Under 18, you may use them only with a parent or guardian who accepts these Terms on your behalf and supervises your use.
4. Accounts
- The anchor alarm, weather, I’m OK and the route planner work without signing in. Trips, pairing and BoatGPT need an account, which is free.
- You sign in with a one time code sent to your email, with Apple or with Google. Keep your email account and your phone secure; what happens under your sign-in is your responsibility until you tell us otherwise.
- You can delete your account at any time from Settings in the App, or as described on this page. Deletion is permanent.
- We may suspend or close an account that breaks these Terms.
5. Using the Services
- Use SafeBoat only for lawful purposes and in accordance with these Terms.
- You are responsible for your device, its battery, its location permission and its connection being suitable for what you ask of the App. An anchor alarm on a phone that is switched off, out of battery or denied location is no alarm.
- Do not modify, reverse engineer, scrape, resell or otherwise exploit the Services or their content, and do not interfere with their operation or with other users.
- Some features have fair use limits, such as a daily number of BoatGPT questions and uploads. We may change these limits.
6. Your content
Anchorage ratings and notes, manuals and photos you upload, boat details and questions you ask are your content. You keep whatever rights you have in it, and you give us the permission we need to store it, process it, show it back to you and, where the feature says so, show it to other users. Specifically:
- Anchorage notes are shown to other users without your name. Write them as you would want to read them, about the place, not about people. We may remove a note, and other users may report one.
- Manuals: only upload documents you are allowed to upload, such as the manuals that came with your boat and its equipment or that the manufacturer publishes. A manual you upload stays private to you. A person on our team reviews it and may approve it as shared, in which case its pages can be cited in answers to other users, without your name; we may also decline or remove it. If you believe a document in the library infringes your rights, write to [email protected] and we will take it down promptly.
- Photos and questions sent to BoatGPT are used to answer you and are kept in your conversations until you delete them.
7. AI features
BoatGPT and the AI route planner produce text written by machine learning models from what you give them and, for BoatGPT, from manual pages. Such text can be wrong, incomplete or out of date, even when it cites a page. Before you act on a torque value, a capacity, a part number, a procedure or a route, check the manual itself, the manufacturer and the official charts. BoatGPT tells you when an answer is general knowledge rather than from a manual; treat general knowledge accordingly. Nothing produced by these features is professional advice.
8. Paired devices, alerts and third-party data
- Alerts to a paired phone travel through mobile networks and push notification services that we do not control. They can be delayed or lost. You decide whom you pair with and what you share; unpair when the sharing should end.
- Forecasts are model output from Open-Meteo and the national weather services behind it, and can differ from what you meet at sea. Maps are built from OpenStreetMap data (© OpenStreetMap contributors), satellite imagery comes from Esri, and none of it is an official nautical chart. Offline maps are for your personal use in the App.
9. Important safety disclaimer
SafeBoat is intended solely as an auxiliary tool for assisting boat owners and captains in monitoring their boat’s safety. It does not replace proper seamanship, navigation skills, an anchor watch kept by a person, or professional safety practices.
By using SafeBoat, you acknowledge and agree that:
- You are solely responsible for your vessel’s operation, safety and decision-making at all times.
- SafeBoat’s data, alerts, answers and recommendations may be delayed, inaccurate, incomplete or unavailable because of signal loss, GPS error, device malfunction, battery, operating system limits, network issues or environmental conditions.
- You must never rely exclusively on SafeBoat to prevent accidents, drifting, grounding or any other risk, and you must check your ground tackle and your position by other means.
- The final responsibility for your safety and your vessel’s safety rests entirely with you, the captain or owner.
9.1. No warranty
The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. SafeBoat makes no guarantee that the App or the Website will function without interruption, error, delay or defect.
To the maximum extent permitted by law, SafeBoat disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, SafeBoat and its owners, developers, affiliates and partners shall not be liable for any direct, indirect, incidental, consequential or punitive damages arising out of or relating to:
- use of, or inability to use, the App or the Website;
- inaccurate data, forecasts, answers or routes, failed or late notifications, or technical issues;
- personal injury, property damage or loss of life;
- boat damage, loss or any other consequence resulting from reliance on the Services.
You agree that any use of SafeBoat is entirely at your own risk.
11. Updates, modifications and termination
SafeBoat may update or modify the Services or these Terms at any time. Continued use after changes are posted means you accept the revised Terms. SafeBoat reserves the right to suspend or terminate access to the Services at any time, without notice, for any reason, including a breach of these Terms.
12. Privacy
Your privacy matters to us. Please read our privacy policy to understand what the Services collect, why, and how to delete it.
13. Governing law
These Terms are governed by and construed in accordance with the laws of Turkiye. Any disputes shall be resolved exclusively in the courts of Izmir, Turkiye.
